The Go4Recycling Customer Portal (hereinafter referred to as the Customer Portal) is a service offered by Go4Recycling GmbH (hereinafter referred to as "Go4Recycling") for its customers, regardless of the country in which their company is located.
Use of the Go4Recycling Customer Portal is subject to the following terms of service:
1. Eligibility
The Go4Recycling Customer Portal offers the customer the opportunity to use the services provided by Go4Recycling over the internet at www.go4recycling.de.
1.1
The Customer Portal is exclusively intended for customers of Go4Recycling GmbH who have an active and unexpired EPR Service Agreement with Go4Recycling GmbH. Persons not belonging to this group may not use the Customer Portal. Use by third parties is not permitted.
1.2
Use of the Go4Recycling Customer Portal requires registration by the customer.
1.3
The right to use the Go4Recycling Customer Portal can only be granted to natural persons. Thus, in the case of a corporate customer, a staff member of the customer can be a user (hereinafter referred to as “authorized user”).
1.4
The right to use the service requires the acceptance of these terms of service by both the customer and the authorized user.
1.5
The usage agreement becomes effective with the release and transmission of access data by Go4Recycling to the customer or the authorized user.
1.6
The customer can revoke the authorization of an authorized user at any time, especially if the authorization to use the Go4Recycling Online Customer Portal has been withdrawn.
2. Technical Requirements
Go4Recycling provides the Customer Portal via a web browser on its website at www.go4recycling.de.
2.1
While Go4Recycling intends to keep the Customer Portal up-to-date to maintain compatibility with changed/new versions of operating systems and mobile devices, there is no entitlement to such updates.
3. Access to Go4Recycling Online Customer Service
Go4Recycling provides the Customer Portal to the authorized person and grants a non-exclusive, non-sublicensable, revocable, and non-transferable right to use the Customer Portal according to the conditions of this agreement.
4. Costs of Using the Go4Recycling Customer Portal
Use of the Go4Recycling Customer Portal is free of charge for the customer and the authorized user.
5. No Legal Advice, Responsibility for Reporting Quantities
No legal advice is provided through the Go4Recycling Customer Portal. Reports are submitted by the customer or the authorized user at their own risk, and the responsibility for reporting quantities lies solely with the customer.
6. Duty of Care and Security Obligations for Access to the Customer Portal
The customer and the authorized user must ensure that no third party gains access to the Go4Recycling Customer Portal to prevent misuse of the Go4Recycling Online Customer Service.
7. Blocking and Termination
7.1
Go4Recycling reserves the right to block a customer or authorized user if there is reasonable suspicion that the user has culpably violated any provision of this agreement.
8. Liability
8.1
Go4Recycling is not liable for incorrect quantity reports submitted by the customer or an authorized user.
8.4
Go4Recycling is liable only in cases of intent or gross negligence and otherwise only for the typical damage in case of breach of essential contractual obligations. Liability for damages resulting from injury to life, body, or health remains unaffected.
9. Changes to the Terms of Service
Go4Recycling may change these terms of service at any time. Notifications of significant changes will be displayed in the Go4Recycling Online Customer Portal. By checking "Accept Terms of Service" during login, the authorized user agrees to the current terms.
10. Termination of Go4Recycling Online Customer Service
10.1
The customer may terminate the usage agreement at any time with immediate effect, provided quantity reporting is allowed through alternative means.
11. Applicability of German Law
The usage agreement is subject to the laws of the Federal Republic of Germany.
12. Usage Data
Upon accessing the Go4Recycling Online Customer Portal, a data record containing various customer information, such as quantity reports in units and weight, date and time of reports, sales quantities, and revenues, is stored on Go4Recycling’s web server.
13. Miscellaneous
Should any provision of this agreement be invalid, the validity of the remaining provisions shall not be affected.
